Welcome to Vivamus AI!

By using Vivamus AI, you agree to these Terms of Service ("Terms"). Please read them carefully.

1. The Service

Vivamus AI is an AI-powered platform that helps you set and achieve meaningful goals through personalized sessions, intelligent routine design, task planning, and guided reflection. Our service includes tools for AI-assisted meditations, coaching, planning, learning and productivity, all tailored to support your personal growth, purpose, and progress.

2. Account Responsibilities

You must be at least 18 years old to use Vivamus AI.
You are responsible for maintaining the confidentiality of your account credentials.
You agree to provide accurate and complete information when creating your account.
You are responsible for all activities that occur under your account.

3. Subscriptions and Payments

Vivamus AI operates on a subscription model with monthly and annual plans. Payment is managed through third-party providers like Stripe.

Subscription fees are charged in advance on a recurring basis.
You authorize us to charge your payment method for all applicable fees.
Prices may change with reasonable notice to you.

4. Refund Policy

Monthly Subscriptions: Monthly subscriptions are non-refundable.
Annual Subscriptions: Annual subscriptions may be refunded on a pro-rated basis for unused months.
Pre-Sale Exclusive Subscriptions: Pre-sale exclusive subscriptions are non-refundable. These discounted plans are offered as a special opportunity to early supporters and cannot be canceled or refunded after purchase.

5. Right of Withdrawal (EU Consumers)

If you are a consumer in the European Union, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days from the day of the conclusion of the contract.

To exercise the right of withdrawal, you must inform us of your decision by email to founders@vivamus.ai with a clear statement of your decision to withdraw.

If you have requested to begin the performance of services during the withdrawal period, you shall pay us an amount proportional to what has been provided until you communicated your withdrawal.

6. User Conduct

By using Vivamus AI, you agree to:

Use the platform only for lawful, respectful, and constructive purposes.
Refrain from attempting to access, interfere with, or disrupt the platform's underlying systems, models, or AI logic.
Avoid copying, reselling, or redistributing AI-generated sessions, content, or proprietary tools without express written permission.
Not use the service to harm, harass, or infringe upon the rights of others.
Not upload or transmit viruses, malware, or other harmful code.

7. Intellectual Property

All content, including but not limited to AI-generated sessions, routine frameworks, branding, software, and designs, is the intellectual property of Vivamus AI. You are granted a limited, non-exclusive, non-transferable license to use the platform for your personal use and goal achievement. Any unauthorized use, reproduction, or redistribution is strictly prohibited.

Content you create or input remains your property, but you grant us a license to use it to provide and improve our services.

8. Data Protection

We process your personal data in accordance with our Privacy Policy and applicable data protection laws, including the General Data Protection Regulation (GDPR). By using our services, you acknowledge that you have read and understood our Privacy Policy.

9. Termination

We reserve the right to terminate or suspend your account for violating these Terms or engaging in unauthorized activities. You may also terminate your account at any time by contacting us.

Upon termination:

Your right to access the service will cease immediately.
We will delete your personal data in accordance with our Privacy Policy.
Any outstanding fees will remain due and payable.

10. Disclaimer of Warranties

Vivamus AI is provided "as is" without warranties of any kind, express or implied. While we strive for accuracy and effectiveness, we do not guarantee:

Specific outcomes or results from using the service.
That the service will be uninterrupted, error-free, or secure.
The accuracy or reliability of any information obtained through the service.

The AI-generated content is for informational purposes only and should not be considered professional advice (medical, legal, financial, or otherwise).

11. Limitation of Liability

To the maximum extent permitted by applicable law, Vivamus AI shall not be liable for:

Indirect, incidental, special, consequential, or punitive damages.
Loss of profits, data, or business opportunities.
Any damages arising from your use or inability to use the service.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

12. Indemnification

You agree to indemnify and hold harmless Vivamus AI and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the service or violation of these Terms.

13. Dispute Resolution

14. Governing Law

These Terms are governed by the laws of Poland. In the event of restructuring to a U.S.-based entity, these Terms will then be governed by the laws of Delaware, United States.

For EU consumers: This choice of law does not deprive you of the protection afforded by provisions of consumer protection laws in your country of residence that cannot be derogated from by agreement.

Any disputes shall be resolved exclusively in the courts of the respective jurisdiction, subject to mandatory consumer protection provisions that may allow you to bring proceedings in your country of residence.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Vivamus AI regarding your use of the service.

17. Changes to These Terms

We may modify these Terms from time to time. We will notify you of material changes via email or through the platform at least 30 days before they take effect. Continued use of Vivamus AI after changes become effective constitutes acceptance of the updated Terms.
